Terms of Service

These terms govern your use of Lust.ai (the "Service"), operated by [TRADING NAME — required before this site is public], [POSTAL ADDRESS — required; a PO box is not sufficient in the UK]. By using the Service you agree to them. If you do not agree, do not use the Service.
1. Who we are

2. Eligibility
The Service produces sexually explicit material. You may use it only if you are at least 18 years old and have reached the age of majority where you live. By using the Service you confirm that this is true.
Access is restricted to authorised accounts. You are responsible for keeping your credentials secret and for everything done through your account.
3. What the Service does
The Service generates images from text descriptions using machine learning models. Every image it produces is synthetic. No photograph of any person is used as an input, and no real person is depicted. Output is probabilistic: the same request will not produce the same image twice, and we do not promise that any particular request will produce a usable result.
4. Acceptable use
You must not use the Service to request, produce, store, or distribute any of the following. This list is a condition of your access and also reflects the terms of the model licences we operate under.
- Any depiction of a minor in a sexual context — real, stylised, cartoon, or wholly synthetic; and any prompt describing a subject as a child, or under 18, or by reference to school age or childhood. This prohibition is absolute and is enforced automatically.
- Any real, identifiable person — by name, by likeness, or by a description specific enough to identify them — without that person's documented consent.
- Non-consensual intimate imagery, including material presented as an authentic depiction of a real person, and any attempt to produce a sexual image of someone who has not consented.
- Content depicting non-consensual sexual activity, coercion, or trafficking as though it were real.
- Content that is unlawful where you are, or where the Service is operated.
- Harassment, defamation, blackmail, or intimidation of any person.
- Automated scraping, load testing, or any attempt to circumvent the sign-in wall, the rate limits, or the prompt filter.
- Resale of access, or presenting output as anything other than AI-generated.
5. How we enforce this
Prompts are screened automatically before they reach the model. A prompt referring to a minor is refused, is not sent to the model, and is recorded together with the account and address that submitted it. That record exists so that this system can be shown to refuse such requests.
We may suspend or terminate access at any time, without notice, for a breach of section 4. Where we are required to, we will report material to the appropriate authority.
6. Your content and ownership
You keep whatever rights you have in the prompts you write and the images you generate. Two limits are worth stating plainly:
- The models we run carry their own licences (CreativeML Open RAIL++-M and fair-ai-public-license-1.0-sd). Their use-based restrictions attach to your use as well as ours, and section 4 above reflects them.
- In several jurisdictions, including the United States, a work produced wholly by a machine without human authorship is not protected by copyright. We make no representation that any image you generate is protectable.
7. Availability, warranties and liability
The Service is provided as is and as available, with no warranty of any kind, express or implied, including fitness for a particular purpose. It depends on rented GPU capacity and may be unavailable, slow, or discontinued without notice.
To the fullest extent the law permits, we are not liable for indirect or consequential loss, lost profits, or lost data arising from your use of the Service. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
8. Changes and termination
We may change these terms; the date at the top of this page shows when they last changed, and continued use after a change means you accept it. You may stop using the Service at any time. We may withdraw access at any time, including by shutting the Service down entirely.
9. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of your own country of residence.
